The use of this site ("site") is subject to these Terms of Use ("terms") for Suite Blue River Accommodation Ltd and its affiliates ("we", "us" or "SBR"), along with any specific terms set forth on any individual pages within this site, as well as any applicable laws and regulations, copyright, trademark and intellectual property rights.

This site offers an online platform to search for, book and use services offered by SBR.  By continuing to use this site, you agree to accept, without limitation or qualifications, all of the terms of use.

1. GENERAL

​

You must be at least 18 years of age and able to form a legally binding contract under applicable law to use the services within this site.  Any additional terms and conditions may apply to reservations, purchases, transactions, uses or activities that may occur on or through the site.  You agree to comply with these terms, and any other applicable terms and conditions.

2. RESERVATIONS

​

A reservation is a limited license to enter, occupy and use the accommodation.  SBR reserves the right to re-enter the space during your stay to the extent that it is reasonably necessary and follows the applicable laws.  If you stay past checkout, SBR has the right to remove you a manner consistent with the applicable laws and apply any reasonable overnight fees.  You may only use this site to make a reservation for you and your invited guests.  You may not use this site to make reservations or purchases for any other purpose, including, but not limited to re-selling your reservation.  You must not exceed the maximum number of allowed guests.  SBR reserves the right to cancel any reservation without notice that does not comply with these terms.

3. CANCELLATIONS, MODIFICATIONS & REFUNDS

​

If you cancel, the amount refunded to you is determined under our cancellation policy.  SBR will only cancel your reservation and refund you the full amount if your accommodation is unavailable for reasons beyond our control.  We will attempt to find  you alternative accommodation should this occur.

     3.1 Cancellation Policy

​

         No refund for cancellations made within 5 days prior to arrival.  Full refund for cancellations made 5 days or more prior to arrival.  Should your travel arrangements change, you should inform us as soon as practicable to allow us to re-allocate the suite(s).

​

         If you are experiencing any COVID19 symptoms (as described by the BCCD: www.bccdc.ca/health-info/diseases-conditions/covid-19/about-covid-19/symptoms) or have tested positive for the virus, please do not enter the building and contact SBR as soon as possible.  We reserve the right to request a positive COVID19 test result in order to come to a decision about the amount refunded.

     3.2 Modifications

​

         By requesting a modification to your existing reservation, you agree to pay for any additional amounts, fees and taxes associated with the modification.

4. PROMOTIONS

​

The site may offer special promotions.  Any such promotional offer is subject to its specific terms, conditions and restrictions.  SBR reserves the right to cancel or alter any offer at any time without notice.

5. YOUR RESPONSIBILITY

​

You are responsible and liable for your own acts, as well as your guests' acts and omissions during your stay at SBR.  This means that you are responsible for leaving the property and its surroundings in the same condition as when you arrived; you must act with integrity and respect at all times; and comply with applicable laws.

You acknowledge and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to and use of the SBR site and your stay at SBR.

You agree that you will not (a) interfere with or disrupt the site, (b) use, place, or distribute any viruses, worms, time bombs, and/or other computer programming routines that damage, intercept, disrupt, or harm (or are intended to do any of the preceding) the site, including the underlying software, hardware, systems, and any users of the site or their devices, (c) use or attempt to use any robot, spider, automatic device, or automatic or manual process to monitor or copy the site without SBR's prior express written consent, or (d) use any device, software, or other instrument to monitor, copy, interfere with, or attempt to interfere with the site, its content, or its operation without SBR's prior express written consent.

The site may contain links to other websites. SBR provides these links solely as a convenience to you. The inclusion of these links in no way indicates SBR's endorsement, support, or approval of such sites, such site’s content, products, or services, or the operators of any such site. We undertake no obligation to review or monitor any sites linked to or from the site. Your use of any such site is at your own risk and subject to the terms and conditions of such sites.

8. WARRANTY DISCLAIMER

YOUR USE OF THE SITE IS AT YOUR OWN RISK. THE SITE IS PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES THAT ARE IMPOSED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.

9. LIMITATION OF LIABILITY

SBR SHALL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR INJURY OR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES ARISING OUT OF YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SITE OR ANY MATERIALS, OPINIONS OR RECOMMENDATIONS OF THIRD PARTIES ON THE SITE. THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF SBR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. SBR'S LIABILITY IN ITS JURISDICTION SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW. YOU HEREBY WAIVE ANY AND ALL CLAIMS AGAINST SBR, ITS AFFILIATES, AGENTS, REPRESENTATIVES AND LICENSORS ARISING OUT OF YOUR USE OF THE SITE OR ANY MATERIALS, OPINIONS OR RECOMMENDATIONS OF THIRD PARTIES ON THE SITE.

10. GOVERNING LAW AND JURISTICTION

This site is controlled and operated by SBR from its office, located in Blue River, BC, Canada.  These Terms of Use and any dispute arising out of or related to the Terms of Use or use of the site shall be governed in all respects by and construed and enforced in accordance with the laws of the province of British Columbia, Canada.  Exclusive jurisdiction over any cause of action arising out of these Terms of Use or your use of the site shall be in provincial or federal courts located near Blue River, BC, Canada. You further agree to submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.

If any part of these Terms of Use is unenforceable, the unenforceable part shall be construed to reflect, as nearly as possible, the original intentions of the parties. All other provisions of these Terms of Use shall remain in full force and effect.

SBR's failure to insist upon or enforce strict performance of any provision of these Terms of Use shall not constitute a waiver of the provision. Neither a course of dealing or conduct between you and us nor any trade practices shall be deemed to modify these Terms of Use.
